Transition to a Fatherless Nation, Father’s Rights and Parental Alienation
Dear Senator/Congressman;
There are several issues in the title of this letter and I wanted to bring attention of the above-interrelated issues to you, the lawmaker. Perhaps when we understand the relationship in these issues we may understand the causes for the escalation in the nation’s education costs while the education results show the opposite trend. We also may understand why our youth are filling the juvenile facilities and later turning to crime. The weight of evidence indicates that the traditional family based upon a married father and mother is still the best environment for raising children, and it forms the soundest basis for the wider society. For many mothers, fathers and children, the ‘fatherless family’ has meant poverty, emotional heartache, ill health, lost opportunities, and a lack of stability. A good society should tolerate people’s right to live as they wish, but it must also hold adults responsible for the consequences of their actions. A divorce decree does not necessarily mean a fatherless family and yet this is what’s happening. The family becomes fatherless when the father disappears from the picture.
The question is “Why our nation is becoming a fatherless nation, with the devastating results affecting the future generations? Why do 60-70% of marriages end in divorce? Why 38% of American men after divorce never see their children again (mass child abduction)? Why 40% of women deliver as single mothers? The main reasons are the laws that are enacted that help and promote easy divorces and by the same token reduce or eliminate any chances for reconciliation by having the process highly adversarial. Then the laws further help fathers get away from their children because men act differently in the family court and this point may have its roots in the male’s evolutional nature - Fight or Flight. For men when it comes to their turfs, including their wife and children, they try to fight, and fighting in court needs to be done in a prescribed and adversarial way, or flight. Most men just cannot fight equally and extensively because of the family and WAVA laws and the legal costs and choose the flight at some point. Heritage and upbringing could account only for the endurance of the choice as to when to transition to a flight. I assume that if this point could be explored further, it could cause a reform and change of direction in this nation’s fatherless transition. Many Women on the other hand choose nowadays to benefit from the WAVA laws to promote their divorce cases thus alienating their ex spouses further away from their children. Further point of notice on this issue is that children that include girls and boys grow up in households, some of which will create abusive adults. The probability of a girl becoming an abusive adult should match the probability of a boy becoming an abuser because of similar background exposure. Taking into account the female genetics and physical differences, I can say that the distribution of abusers may not be exactly the same and there are more abusive men than abusive women. However, an abusive man will go to jail on acts of abuse and will be removed from his children, and an abusive woman can abuse with impunity, since she knows a man will have little, if any, recourse in the legal system, and that in the event of a breakdown in the relationship, she will have custody of the children and can use them as a weapon.
I had conversations with many men and I have read many stories of men who went though a divorce and we all share many common experiences. I wanted to use my personal experience to make a point that laws must change for the benefit of the citizens of this country. This is not only my story but of millions of other men throughout this vast land with common experiences of the divorce process.
It is hard to comprehend that in this empire of democracy a man can be easily removed from his house, stopped visitations with his children for over a year, accused of being mentally insane and dangerous, constantly harassed by law enforcement without even one tangible proof and then get served with an order of protection. Any manipulative person with some knowledge of the system and the laws can easily do this. I wanted to bring to your attention that I, an American citizen was defrauded by my foreign spouse who entered into this marriage of convenience for the purpose of acquiring permanent residency in the United States of America and evading the immigration laws of the United States of America. In her zeal to achieve in this land of opportunities she has disposed all of my assets that took me a lifetime to accumulate, got several university degrees at my expense and as soon as she got her temporary residence she filed for a divorce, stopped visitations with my children, tried to frame me as mentally insane and dangerous and used the local police as though it is her own force by filing dozens of police reports. The incongruous issue is that I was forced to leave my house and was not in the vicinity of my house or my children for over 15 months. However, for immigration purposes she needed to prove Domestic Violence. She has exploited statutes within the United States immigration system that were created by the Violence Against Women Act (VAWA) of 1996. These statutes have the honorable intention of aiding abused women, but now they are being used dishonorably by some foreign nationals and deflecting benefit away from those truly in need.
Please understand that I am writing this letter not as someone who is anti-women or anti-immigrant, but as an American citizen that is concerned about the next generation and about protecting the rights of other American citizens and of myself. My life is being destroyed as my house, my children and my life savings were taken away, my nationality and religion were entered into family court litigation, and the police are often called without any tangible reason. The NJ department of Youth Family Services is often in my house, even though I have not lived with my children for over a year. I live in fear because of false accusations and constant threats by my spouse and her sister, who now live in my house. My spouse who just recently became a Psychologist with the contributions of my life savings deemed me insane before the court and the police, surprisingly just after she got her temporary residence and education. I had to go through a lengthy process to prove otherwise. I had to leave my house with a police escort when my spouse started her scheme to get rid of me and I live in a rented apartment without access to my children. However, NJ DYFS and the police are still involved for one simple reason regarding immigration, visitations with the children, and my spouse’s desire to claim completely my last asset, my house.
I thought I was marrying for love and happiness and I did not realize I was entering into marriage fraud. Unfortunately, my spouse went through great lengths for her chance to stay in the United States to avoid deportation as a deportation order was already issued against her after she entered this country with her then husband, filing for political asylum, claiming to be Jewish Refugees, which was not true. The first thing she did after our separation was to baptize our children, stop visitations completely and then proceed to cause Parental Alienation which may be deemed as child abuse.
I had acquired legal help in order to grant her temporary residence that had burdened me financially. After receiving her temporary residence and her completion of her studies my spouse filed for a divorce and I was removed from my home because of a bogus Temporary Order of Protection which was given to her family members who do not reside in the US or speak English, based on an alleged phone-call that was never made. In addition, she works in a highly guarded prison and what protection does she needs from her computer expert husband? In order for my spouse to remove temporary residency conditions, thus giving her permanent residency, she claimed to be a victim of abuse, because of alleged phone call! This could not be true, because several months earlier she wrote an essay for her school stating that she was happily married. Furthermore, she stated in court documents that she and our children were never abused. However, when she found out that she needs to provide a proof of abuse, she filed dozens of police reports and went several times to the county courthouse until she finally received a Final Domestic Protection Order, for her family living overseas, strangely without any valid proof of abuse and the fact that I do not speak Russian and could not make the alleged phone call which was the basis of the FRO. This Domestic Protection Order in the eyes of the USCIS qualifies her as a victim of domestic abuse under the battered immigrant women provision of VAWA and she can now file a self-petition with the USCIS to remove the temporary conditions. Now, even with supplied evidence which shows that she entered into the marriage fraudulently to evade immigration laws, I cannot do anything and I am now labeled as an abuser by the US government, by the family court and by the local police. I am praying and asking GOD and you the elected official to gain my freedom of false accusations and harassment. I am not interested in any immigration action against her as she is still the mother of my children, even though it seems I have lost my children because of stopped visitation, severe Parental Alienation and constant brain wash.
I understand that VAWA was put into place to help protect women. I understand this battered women provision of VAWA was put into place so that an abused woman had options, and was not at the mercy of an abusive spouse. But, this provision does not provide safeguards against false claims, fraud, deceit, or deception. It does not allow an innocent American citizen to defend himself when a false allegation of abuse is made. This provision is taking away the Constitutional right of due process from United States Citizens.
The other issue I wanted to bring to your attention is the effects of Parental Alienation as the psychological future of our next generations depends on laws that help prevent this widespread phenomenon. The primary person responsible for the induction of a Parental Alienation syndrome (PAS) in a child is the litigating parent who hopes to gain leverage in a court of law by programming in the child a campaign of denigration directed against a target parent. In most cases alienated parents are relatively helpless to protect themselves from the indoctrinations and the destruction of what was once a good, loving bond. I have lost my children, strangely enough, with the police and courts help who were manipulated into actions, which defrauded a father’s rights to relationship with his children.
I was always a law-abiding citizen and I do respect the Legal System, the Courts, its orders and the orderly process managed by the police that allow our system of justice to work. I have respect and admiration for this great nation and its institutions. The above issues are of danger to our nation with much grave consequences compared to any other outside threats. I hope that you will take the lead and review these provisions, and be an advocate for change, help parents maintain relationships with their children and be an advocate for all falsely accused American citizens.

In summary I am asking you the lawmaker to consider the following:
1. Change WAVA laws to include penalties for false claims, fraud, deceit, or deception.
2. Increase the temporary resident provisions of the immigration law to at least 7 years, by that reducing marriage fraud.
3. Disconnect WAVA laws from immigration laws.
4. Enact laws that demand Police actions on false filing of police reports.
5. Enforce child visitation laws that include strict enforcement of visitations, and penalize parents who stop visitations.
6. Enact laws that will encourage fathers’ participation in the upbringing of their children thus encouraging payment of child support.
7. Enact laws that will encourage fathers’ visitation with their children.
8. Require Matrimonial attorneys to require a mandatory settlement regarding visitations agreements and means to enforce these agreements within the first months of the parents’ separation.
9. Enact laws that will mandate reconciliation and mediation efforts prior to divorce judgment.
10. Mandate diversity training for all Judges.
11. Mandate introduction to prenuptial agreements for all marriages initiated with disparity of assets.
12. Enact laws that will stop Parental Alienation abuse from its start.
13.Enact laws that will strictly enforce licensing and monitoring activities of psychologists, psychotherapists, and child therapists.
